Guidelines for derivative works

About Copyrights

All rights to Momobana Tokiko's avatar and copyrighted materials are owned by me with some exceptions.[1]

Regarding unauthorized reproduction or use of copyrighted materials, we may take action without notice if we deem the use is malicious and for purposes other than private use.


About Secondary Works - Momobana Tokiko

You may freely create derivative works of Momobana Tokiko under any circumstances, as long as you observe the following precautions.

  • Any creation that is detrimental to her (me) or others will be prohibited.

    • └（(Slander, defamation, etc. that tarnish your image of me)）

  • We will request you to stop the production and sale of goods that use official images (such as images officially published by us on our website or official Twitter account, screenshots of distribution, etc.) without permission as soon as we find them.

    • └If you produce the work for personal use, it is not eligible. In that case, you may post it on social networking sites, but please be sure to credit us.

  • Credit is not required when publishing or selling derivative works that do not use official images, but we recommend using the following hashtags when publishing on social networking sites.[2]

  • No watermark is attached, but the act of having the AI learn the official image is prohibited.


    • About Secondary Works - Creative Works

    Regarding derivative works of copyrighted works, the guidelines are basically almost the same as her (my) guidelines for derivative works.


  • Any creation that is detrimental to her (me) or others will be prohibited.
  • Creations that damage the image of the copyrighted work are prohibited.
  • We will request you to stop the production and sale of goods that use official images or officially published novels without permission as soon as we find them.

    └If you produce the work for personal use, it is not eligible. In that case, you may post it on social networking sites, but please be sure to include the title and credit the author.

    Credit is not required when publishing or selling derivative works that do not use official images, but we recommend using the following hashtags when publishing on social networking sites.[2]

  • When you are planning to publish, produce goods, or sell creative works by or involving companies, large or small, please contact us stating the purpose of use and the intended purpose of use.[3]
  • The act of having AI learn official images or novels is prohibited.


    • About Secondary Works - Tokigoe Touka／Tokigoe Touji

    Their secondary creations are basically the same as Momobana Tokiko's secondary creation guidelines and Momobana Tokiko's creative secondary creation guidelines.


  • When using UTAU voice libraries and secondary creations of characters, you are free to use them commercially or non-commercially as long as you comply with the following precautions.
  • Please refrain from using songs (including cover songs) that may damage their image.
  • You may modify the design and age settings as desired. Since they are 10 years old, please ensure to adjust their age to comply with the laws of your country when using them in adult-oriented songs or derivative works.
  • You may use UTAU voice libraries and characters for commercial purposes in derivative works. When using them commercially, please include the following credit notation.

  • As a general rule, training AI with official images and audio libraries, as well as redistributing or processing audio libraries, is prohibited.

  • Season 1 Avatar (hereafter referred to as “old avatar”)

    • The old avatar is the copyrighted work of 株式会社カスタムキャスト. The copyright is owned by 株式会社カスタムキャスト and does not belong to her (me), so it is a copyrighted work that is not covered by these guidelines. Instead, she (I) is working in accordance with 株式会社カスタムキャストの個人利用のガイドラインwhen using the old avatar. Please see 株式会社カスタムキャストの個人利用のガイドライン for more information.

  • Secondary works by her (me)

    • The copyrights of characters and other secondary creation activities, including fan art of other VTubers such as #Tabinoki_art and だすきあーとare not covered by these guidelines, as they belong to the original creators and tag owners of each.[4]

  • Works produced by commission or other means

    • Copyrights to works created by requests and requests, whether paid or unpaid, are transferred to the requester unless they are anonymous. Anonymous here means that the client's name is not described.

    [2]：Illustrations published using the hashtag may be used as thumbnail material for distribution. In that case, she (I) will ask for permission to use them in advance by DM or other means.

    [4]：Each VTuber is free to use fan art submitted by her (me) for thumbnails, etc., regardless of these guidelines, and with or without notice or permission. However, please give credit to the artist when using the art.
